The municipality of Nijemci (5,998 inhabitants in 2001; 1,905 in the village of Nijemci) is located 30 km south-east of Vukovar. About 10% of the today's population are Serbs. The village and the entire municipality were heavily damaged during the Homeland War in the 1990s. In the 16th century, the place was under Ottoman rule; after liberation in the beginning of the 18th century, it was populated by people mostly from Lika and Dalmatia. The name of the place literally means "Germans", possibly indicating a previous population.

The symbols of Nijemci are described in the Municipal Statutes Statut općine Nijemci, adopted on 5 October 2001 by the Municipality Assembly and published on 22 October 2001 in the County official gazette Službeni vjesnik Vukovarsko-srijemske županije, No. 12. This is repeated in the Municipal Statutes Statut općine Nijemci, adopted on 28 January 2006 and published the same day in Službeni vjesnik Vukovarsko-srijemske županije, No. 1.
Article Natječaj za izradu idejnog rješenja grba i zastave Općine Nijemci, published on 21 July 1995 in Vinkovački list (scan) announced the contest for the design of the symbols of Nijemci. The design should include a coat of arms, "but without the elements of the historical coat of arms of Croatia", it should be a shield only, with the elements within it, and the flag should be of a single colour. Prizes of 3000, 2000 and 1000 HRK were prescribed. The deadline was set to eight days after the announcement.
The flag is described as "vertically divided into green and white with the coat of arms, bordered yellow, in the middle". The flag is also used horizontally (photos, photo).

The coat of arms is described in the Statutes as follows:
The coat of arms of the Municipality of Nijemci is composed of a shield divided into two fields: blue and green. In the blue, in top left, is a six-pointed star - colored golden. Opposite to it, in the right top part is a crescent - colored golden. In the green part, there are two wavy links - colored silver with blue wavy cut within the silver.
On the arched cut dividing the shield into two fields, from the green, is issuing a fort - colored silver, with embattlements at the top, masoned, with open doors, loopholes and a cross above the doors. The loopholes, the interior of the doors and the cross are colored black. The doors wings are opened and arched at the top - colored brown.
From the green field, left from the tower, is issuing a horse rampant - colored black. The shield is outlined with golden.
