By Law of 24 July 1991; Serbia is divided in 29 Districts (okrugi) and the District-Town of Belgrade (Grad Beograd), all of them being divided into Municipalities (opštine). The municipalities can be further divided in Local Communities (mesna zajednica), which represent the smallest territorial unit in Serbia.
Novi Sad, Niš and Kragujevac have the status of town (grad), Niš and Kragujevac being divided into municipalities. The Law on the Territorial Organization of the Republic of Serbia, adopted by the People's Assembly on 28 December 2007, further granted the status of town to Čačak, Jagodina, Kraljevo, Kruševac, Leskovac, Loznica, Novi Pazar, Pančevo, Požarevac, Priština, Smederevo, Sombor, Sremska Mitrovica, Subotica, Šabac, Užice, Valjevo, Vranje, Zaječar and Zrenjanin.

The municipal flags in Serbia can be "classified" as follows, according to the status of the municipal coat of arms:
1. The municipal coat of arms was adopted according to the new Serbian heraldry trend, in the 1990s and after; it was often proposed/designed by the Serbian Heraldry Society (SHD), but not always. In Vojvodina, the tradional coat of arms were refreshed by the SHD).
In such cases, the greater coat of arms always includes a banner of the municipal arms, which is automtically considered as the municipal flag, but there are four possible situations.
1a. The flag is similar to the banner of arms shown in the greater coat of arms. It should be the only correct usage.
Examples: Belgrade, New Belgrade, Zvezdara, Rakovica, Užice, Kragujevac, Leskovac, Jagodina, Gornji Milanovac (indoor flag).
1b. The flag is similar to the banner of arms shown in the greater coat of arms, but with different proportions.
Examples: Šabac (long hanging flag), Gornji Milanovac (outdoor hanging flag, matching ratio of national flag 2:3), rare examples of Belgrade flag (proportions different, to match the proportions of the national flag or of the flag of certain institiution), etc.
1c. The flag is different from the banner of arms shown in the greater coat of arms. Examples: Niš (blue flag with the greater coat of arms in canton), Rakovica (white flag with greater coat of arms, no longer in use)
1d. The flag is similar to the banner of arms shown in the greater coat of arms, but its use was never reported.
Examples: Savski Venac, Čukarica, Štrpce, Istok, etc.
2. The municipal coat of arms was adopted recently, as a reconstruction or slight modification in the Austro-Hungarian tradition. In some cases, the flags are monocolours with the coat of arms (examples: Novi Sad, Pančevo), or bicolours (examples: Subotica - with coat of arms, Zemun - simple bicolour). In other cases, there is no flag reported yet (examples: Bačka Topola, Vršac, Kikinda).
3. The coat of arms is a relict from Socialist Yugoslavia, or a new coat of arms was designed, inspired by the pseudo-heraldry of Socalist Yugoslavia (conditionally called here "coats of arms", because they are pseudo-heraldic creations. These municipalities use flags only in some cases with the emblem on plain colour, or simple divided flags (examples: Pirot, Ražanj, Kačanik), others do not use flags or there is no report about them (examples: Kula, Lebane, Grocka, Sopot, Čačak, Krupanj, etc.).
